PLEASE READ THIS DISCLAIMER CAREFULLY. IT CONTAINS IMPORTANT INFORMATION REGARDING TENNESSEE LAW.
1. Non-Affiliation & Referral Service: Fresh Perspectives Group ("FPG," "we," "our") operates this landing page as an independent marketing and lead generation service for psychiatric mental health nurse practitioners ("PMHNPs") considering practice opportunities. We are not Grow Therapy, nor are we a subsidiary, partner, or legal agent of Grow Therapy. We are a separate referral source.
2. Not a Healthcare Provider or Employment Agency: FPG does not provide healthcare, medical advice, or employment services. We do not employ PMHNPs. We are not licensed healthcare professionals or a staffing agency. Any potential practice opportunity or contractual relationship is solely between the PMHNP and Grow Therapy.
3. Tennessee Practice Compliance Disclaimer:
· It is the sole and exclusive responsibility of each PMHNP to ensure full compliance with all Tennessee laws and regulations governing their practice, including but not limited to:
· The Tennessee Nurse Practice Act (T.C.A. §§ 63-7-101 et seq.).
· Rules and regulations of the Tennessee Board of Nursing.
· Requirements for a Collaborative Practice Agreement with a Tennessee-licensed physician, as required by T.C.A. § 63-7-123 and Rule 1000-04-.08.
· State laws regarding prescriptive authority, including controlled substance prescribing (T.C.A. § 63-7-126).
· Telehealth regulations (T.C.A. §§ 63-1-150, et seq.), if applicable to the practice model.
· HIPAA and Tennessee privacy laws.
· FPG does not verify, guarantee, or assume responsibility for the compliance status, licensure, certification, or collaborative agreements of any PMHNP or the opportunities presented by Grow Therapy. We do not provide legal or compliance advice.
4. No Endorsement or Warranty: Any referral or connection to Grow Therapy does not constitute an endorsement, guarantee, or warranty of the terms, compensation, work environment, or legal/compliance structure of the opportunity. PMHNPs must perform their own due diligence, including reviewing all contracts with a qualified Tennessee healthcare attorney.
5. Limitation of Liability: To the fullest extent permitted under Tennessee law, FPG, its members, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to:
· A PMHNP's decision to engage with Grow Therapy.
· Any issues related to a PMHNP's Tennessee licensure, collaborative agreement, or scope of practice.
· Any contractual, payment, or clinical disputes between a PMHNP and Grow Therapy.
· Any alleged violation of Tennessee law by a PMHNP or Grow Therapy.

PART 2: TERMS AND CONDITIONS OF USE
BY USING THIS TENNESSEE-TARGETED LANDING PAGE, YOU (THE "USER," PRESUMABLY A LICENSED PMHNP) AGREE TO THESE TERMS.
1. Acceptance & Tennessee Jurisdiction
Your use of this Site is governed by these Terms and Tennessee law. You affirm you are a licensed healthcare professional or are seeking information in that capacity.
2. User Representations & Warranties
If you are a PMHNP, you represent and warrant that:
· You hold a current, unencumbered Tennessee APRN license with psychiatric mental health certification.
· You maintain, or will secure prior to practice, a compliant Collaborative Practice Agreement as required by Tennessee law.
· You are solely responsible for maintaining professional liability insurance.
· You will independently verify any practice opportunity's compliance with Tennessee regulations.
3. Intellectual Property
All Site content is the property of FPG or its licensors. You may not use our name, logos, or content in a way that suggests we sponsor or guarantee your practice.
4. No Professional Relationship
Use of this Site does not create a client, advisory, or employment relationship between you and FPG. We are a marketing conduit only.
5. Third-Party Services (Grow Therapy)
You acknowledge that Grow Therapy is a separate entity with its own terms, privacy policy, and contractual agreements. FPG is not a party to any agreement you enter with Grow Therapy and disclaims all liability related to such agreements.
6. Indemnification
You agree to indemnify, defend, and hold harmless FPG from any claims, losses, or damages (including attorneys' fees) arising from:
· Your violation of these Terms.
· Your practice as a PMHNP in Tennessee, including any alleged non-compliance with state laws.
· Your relationship with Grow Therapy.
7. Disclaimer of Warranties
THE SITE AND REFERRAL SERVICE ARE PROVIDED "AS IS." FPG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
8. Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL FPG BE LIABLE FOR ANY DAMAGES (INCLUDING LOST PROFITS, LICENSURE ISSUES, OR DISCIPLINARY ACTIONS) RESULTING FROM YOUR USE OF THE SITE OR YOUR ENGAGEMENT WITH GROW THERAPY. YOUR SOLE REMEDY IS TO DISCONTINUE USING THE SITE.
9. Governing Law, Venue & Severability
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. Any legal action shall be brought exclusively in the state or federal courts located in Davidson County, Tennessee. If any provision is invalid, the remainder shall remain in effect.
10. Modifications
FPG reserves the right to modify these Terms at any time. The updated version will be posted with a new "Last Updated" date.

BY SUBMITTING INFORMATION THROUGH THIS LANDING PAGE, I ACKNOWLEDGE AND AGREE THAT:

2. FRESH PERSPECTIVES GROUP IS A MARKETING REFERRAL SERVICE ONLY AND IS NOT RESPONSIBLE FOR MY COMPLIANCE WITH TENNESSEE'S NURSE PRACTICE ACT, BOARD OF NURSING RULES, OR REQUIREMENTS FOR COLLABORATIVE PRACTICE AGREEMENTS.
3. I AM SOLELY RESPONSIBLE FOR VERIFYING MY LICENSURE, SECURING A COMPLIANT COLLABORATIVE AGREEMENT, AND ENSURING ANY PRACTICE OPPORTUNITY WITH GROW THERAPY MEETS ALL TENNESSEE LEGAL AND REGULATORY STANDARDS.
4. I AM ADVISED TO CONSULT WITH A QUALIFIED TENNESSEE HEALTHCARE ATTORNEY BEFORE ENTERING INTO ANY PRACTICE OR INDEPENDENT CONTRACTOR AGREEMENT.
